Why Location AND Ownership Matter

Many people assume that if a server is located in the EU, it's automatically GDPR-safe. That's not always true. Here's why you need to check both:

EU Location + EU Owner

Best case. The data is stored in the EU and the infrastructure is controlled by an EU-headquartered company subject to EU law.

EU Location + Non-EU Owner

The server is in the EU, but the provider is a US company (e.g., AWS, Azure, GCP). Subject to US laws like the CLOUD Act, which can conflict with GDPR.

Non-EU Location

Data is processed outside the EU entirely. Requires adequate safeguards like Standard Contractual Clauses (SCCs) for GDPR compliance.

The US Cloud Act Problem

The CLOUD Act (2018) allows US law enforcement to compel US-based tech companies to hand over data, even if that data is stored in EU data centers. This means an AWS server in Frankfurt could still be accessed by US authorities without going through EU legal channels.

This is why ownership matters as much as location. EU-headquartered providers like Hetzner, OVH, and Scaleway are not subject to the CLOUD Act.

GDPR compliance is a legal assessment that depends on many factors beyond IP location, including data processing agreements, organizational measures, and the specific data being processed.

How accurate is the IP location data?

Country-level accuracy is typically 95-99% using the MaxMind GeoLite2 database. City-level accuracy is lower. The data is updated regularly but may not reflect very recent changes in IP allocations.

What does "EU entity" mean?

We check if the organization that owns the IP address (via ASN registration) is headquartered in an EU member state. This matters because companies incorporated in the EU are directly subject to GDPR, while non-EU companies may be subject to other jurisdictions (like the US CLOUD Act).

Why does my AWS EU server show as "non-EU owned"?

Amazon Web Services is a US company headquartered in Seattle. Even though your server may be in Frankfurt (eu-central-1), the infrastructure is owned by Amazon.com, Inc., a US entity subject to US law including the CLOUD Act.

What about VPNs and proxies?

This tool checks the IP address you provide, which may be a VPN or proxy endpoint. It cannot detect whether the user behind that IP is using a VPN. The location and ownership data reflects the VPN/proxy provider's infrastructure, not the end user's actual location.

Can I check IPv6 addresses?

Yes, the MaxMind GeoLite2 database supports both IPv4 and IPv6 addresses.
